Getting fair compensation for a personal injury case

On Behalf of | Oct 24, 2023 | Personal Injury

If you’ve been injured in a car accident caused by someone else’s negligence, then you’ll want to think about taking legal action. While a successful personal injury claim can give you a sense of justice and help you move past your crash, most accident victims want to ensure that they recover the compensation they need for an effective recovery.

This is where you’re bound to face a lot of friction in your personal injury case. If you’re adverse to conflict, or you want quick access to cash, then you might be tempted to settle your case as quickly as possible. This can put you at a significant long-term disadvantage.

That’s why before you head into settlement negotiations or full-blown litigation, you need to have an understanding of what you can do to maximize your compensatory recovery.

Increase the damages that you recover from your personal injury lawsuit

You can’t sit down at the negotiation table or walk into the courtroom and simply state the amount of money that you want from your claim and receive it. Instead, you’ll have to present evidence to support your position. Here are some ways that you can generate and gather that evidence:

  • Seek out treatment for all injuries: You should certainly seek immediate medical attention after your accident, but some of your injuries might not present themselves right away. Even when injuries appear late or your mental health takes a toll in the aftermath of your wreck, you need to seek treatment. Not only will this set you up for a successful recovery, but it’ll also generate a record of the treatment you’ve received and the treatment that you still need.
  • Follow treatment recommendations: Your doctors are going to give you recommendations for ongoing treatment. If you don’t follow those recommendations, then you won’t be able to claim damages for that treatment.
  • Track expenses: As you progress in your recovery, you’re going to incur several expenses. If you don’t track them, it’s going to be hard to claim them as damages in your personal injury case. Therefore, it’s a good idea to establish a system that allows you to record these expenses and retain receipts and invoices related to them.
  • Keep a journal: Your claim for economic losses is supported by documentation, making them easier to prove. Non-economic losses are subjective, though, which can make it difficult to demonstrate them. One effective way to show these losses, is to keep a journal that you write in daily during your recovery. By keeping this journal, you can help paint a picture of how your accident injuries have negatively impacted your life, showing everything from your pain and suffering to your loss of enjoyment of life.
  • Avoid social media: Although social media can be a great way to connect with others, it can also pose a threat to your personal injury case. This is because your pictures and posts can be taken out of context and used against you by showing that your injuries aren’t as significant as you claim them to be. So, you might be able to protect your ability to recover the damages that you need by staying away from social media while your personal injury case is pending.
